Terms and Conditions

By accessing or using the FainTrading platform ("Platform", "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Faintech Solutions SRL ("Company", "we", "us"). We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of those modifications.

FainTrading is an options trading education and execution platform that provides:

• Trading School - Educational content about options trading strategies
• Paper Trading - Simulated trading environment with virtual money
• Strategy Builder - Tools for analyzing and constructing options strategies
• AI Trading Advice - AI-powered educational explanations (not financial advice)
• Live Trading Integration - Connection to tastytrade brokerage (Pro Trader only)

To use certain features of the Platform, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 18 years old to use the Platform

FainTrading offers integration with tastytrade brokerage for live trading (Pro Trader). By connecting your tastytrade account:

• You authorize FainTrading to access your account data via OAuth2
• You acknowledge that tastytrade is a separate company with its own terms and conditions
• You understand that trades executed are your sole responsibility
• You accept that FainTrading is not responsible for any losses from live trading
• You agree to comply with tastytrade's terms and applicable regulations

FainTrading acts only as a software interface. tastytrade is the regulated broker-dealer, the counterparty to your trades, and the sole custodian of your funds and securities. Order routing, execution quality, fills, slippage, margin enforcement, assignment, and settlement are tastytrade's responsibility — not FainTrading's. FainTrading does not hold client funds, does not take principal risk, and does not guarantee execution of any order routed via its software.

FainTrading offers a free tier and one Pro Trader subscription. All payments are processed securely through Stripe.

Subscription Tiers:

• Free: Limited access on the permanent free tier
• Pro Trader: Premium AI tokens and Opus model (29 EUR/month)
• Pro Trader: Premium AI tokens and Opus model (29 EUR/month)
• Pro Trader: Premium AI tokens and Opus model (29 EUR/month)

Billing:

• Subscriptions are billed monthly or annually in advance
• Prices are displayed in local currency based on your region
• Annual subscriptions receive approximately 2.5 months free (20% discount)
• All prices are subject to applicable VAT/taxes

All content on FainTrading, including but not limited to text, graphics, logos, icons, images, audio, video, software, and educational materials, is the property of Faintech Solutions SRL and is protected by copyright and other intellectual property laws.

• You may not copy, modify, distribute, or reproduce any content without written permission
• Educational materials are licensed for personal, non-commercial use only
• You may not use our trademarks or branding without authorization
• User-generated content (if any) remains your property, but you grant us license to use it

The FainTrading name, logo, and related marks are trademarks of Faintech Solutions SRL.

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Attempting to circumvent subscription restrictions or payment systems
• Reverse engineering, decompiling, or disassembling any part of the Platform
• Sharing account credentials or allowing unauthorized access
• Using automated systems to access the Platform (bots, scrapers)
• Interfering with the Platform's operation or security
• Harassing other users or engaging in abusive behavior

Either party may terminate the account relationship at any time.

Termination by You:

You may cancel your subscription and delete your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Termination by Us:

We may suspend or terminate your account immediately if we determine that:

• You have violated these Terms
• Your payment method has failed and cannot be updated
• You are using the Platform for fraudulent or illegal purposes
• Continued use poses a risk to the Platform or other users

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAINTECH SOLUTIONS SRL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.

We are specifically NOT liable for:

• Any trading losses you incur, whether using paper trading or live trading
• Decisions you make based on educational content or AI suggestions
• Technical failures, data inaccuracies, or service interruptions
• Actions of third-party services (tastytrade, Stripe, etc.)
• Market conditions or external factors affecting your trades

Subject to the mandatory-law clause below, our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Faintech Solutions SRL and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. The courts of Romania shall have exclusive jurisdiction over any disputes arising from these Terms.

If you are a consumer in the European Union, you may also be entitled to the protections of the mandatory consumer protection laws of your country of residence.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Platform.
