Terms and Conditions

By accessing or using the FainTrading platform ("Platform", "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all the terms and conditions, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Faintech Solutions SRL ("Company", "we", "us"). We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of those modifications.

FainTrading is an options school with market news and simulated practice. It provides:

• Trading School - Educational content about options trading strategies
• Practice - Simulated options with virtual cash and dummy prices

To use certain features of the Platform, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring you are at least 18 years old to use the Platform

Practice uses simulated prices and virtual cash. FainTrading does not connect a broker and does not place real orders.

• Simulated fills are not live market fills.
• FainTrading does not hold client funds and does not route orders.
• You are responsible for understanding that Practice is education, not a brokerage account.

FainTrading does not provide a trading bot, discretionary management, or an investment service. Nothing on the platform sends orders to a broker.

• Paper-trading accounts, strategy backtests, readiness scores, and bot simulations on FainTrading are simulated (hypothetical) results computed from market data — not live, executed performance.
• Simulated results benefit from hindsight, do not model the full effect of spreads, slippage, fees, liquidity, and margin enforcement, and typically overstate real-world outcomes.
• Any simulated or hypothetical figure shown on the Platform is labeled as such and is provided for educational purposes only.
• Past performance — real or simulated — is not a reliable indicator of future results.

AI features on FainTrading (the AI Coach, lesson explanations, journal reviews, portfolio narratives, and generated trade ideas) are educational tools powered by third-party language models.

• AI outputs are educational explanations of concepts and mechanics. They are not investment advice, personal recommendations, or suitability assessments, and they are never tailored advice to act on.
• AI outputs may be inaccurate, incomplete, or fabricated (model hallucination), including figures, symbols, and strategy mechanics. Verify every statement independently before relying on it.
• Scores and assessments produced by AI are educational self-assessment of your knowledge and process, not a signal to trade or a measure of the merits of any transaction.
• Do not treat any AI output as the sole basis for a trading decision. You remain solely responsible for your decisions.

Where the Platform displays performance of other users (shared journal results, community statistics, or leaderboards), that information is an educational record of what another user reportedly did — not a recommendation to trade, follow, or copy anyone.

• Community performance data is shown for educational purposes only and does not constitute investment advice or an offer or solicitation to follow any strategy.
• We do not compensate community members for being followed, share revenue with them, or enter commercial arrangements that would reward them for the performance they display.
• Reported results may be simulated (paper trading), selectively shared, unverified, or affected by hindsight, and typically differ from results you could obtain.
• Past performance of any user is not a reliable indicator of your future results.

FainTrading offers a free tier and one Pro Trader subscription. All payments are processed securely through Stripe.

Subscription Tiers:

• Free: Limited access on the permanent free tier
• Pro Trader: Premium AI tokens and advanced AI model (current price shown on the Pricing page)

Billing:

• Subscriptions are billed monthly or annually in advance
• Prices are displayed in local currency based on your region
• Annual subscriptions receive approximately 2.5 months free (20% discount)
• All prices are subject to applicable VAT/taxes

All content on FainTrading, including but not limited to text, graphics, logos, icons, images, audio, video, software, and educational materials, is the property of Faintech Solutions SRL and is protected by copyright and other intellectual property laws.

• You may not copy, modify, distribute, or reproduce any content without written permission
• Educational materials are licensed for personal, non-commercial use only
• You may not use our trademarks or branding without authorization
• User-generated content (if any) remains your property, but you grant us license to use it

The FainTrading name, logo, and related marks are trademarks of Faintech Solutions SRL.

You agree not to engage in any of the following prohibited activities:

• Violating any applicable laws or regulations
• Attempting to circumvent subscription restrictions or payment systems
• Reverse engineering, decompiling, or disassembling any part of the Platform
• Sharing account credentials or allowing unauthorized access
• Using automated systems to access the Platform (bots, scrapers)
• Interfering with the Platform's operation or security
• Harassing other users or engaging in abusive behavior

Either party may terminate the account relationship at any time.

Termination by You:

You may cancel your subscription and delete your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.

Termination by Us:

We may suspend or terminate your account immediately if we determine that:

• You have violated these Terms
• Your payment method has failed and cannot be updated
• You are using the Platform for fraudulent or illegal purposes
• Continued use poses a risk to the Platform or other users

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAINTECH SOLUTIONS SRL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM.

We are specifically NOT liable for:

• Any trading losses you incur, whether using paper trading or live trading
• Decisions you make based on educational content or AI suggestions
• Technical failures, data inaccuracies, or service interruptions
• Actions of third-party services (Stripe, news vendors, and similar)
• Market conditions or external factors affecting your trades

Subject to the mandatory-law clause below, our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Faintech Solutions SRL and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by, and shall be construed in accordance with, the laws of Romania, without regard to its conflict-of-law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms — including their formation, interpretation, performance, or termination — shall be submitted to the exclusive jurisdiction of Tribunalul București (the Bucharest Tribunal), Romania.

If you are a consumer resident in the European Union, this jurisdiction clause does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, including your right under EU Regulation 1215/2012 (Brussels I recast) to bring proceedings in, or be sued only in, the courts of your country of residence. Nothing in these Terms limits any non-waivable rights you have under applicable EU consumer law.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Platform. Your continued use of the Platform after changes become effective constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Platform.
